If a mass transit system won't run your firm's transit ads, you can sue them for violation of your First amendment rights to free speech.
That's exactly what Take-Two is doing. They publish the extremely popular game series Grand Theft Auto, and their latest $300,000 ad campaign for Grand Theft Auto IV was rejected by the Chicago Transit Authority (CTA).
The suit was filed against both the CTA and Titan Outdoor LLC, the CTA's external advertising agent. In suing the CTA, Take-Two notes that its free-speech rights were violated, but they also claim that the CTA broke a contractual agreement without justification.
As part of the CTA lawsuit, Take-Two is asking the CTA to run the ads and pay at least $300,000 in damages.
The CTA counters that it has the right to regulate and establish guidelines for advertising on its properties.
